The Chancery Court of the State of Wyoming represents an incredible step forward for the Equality state and the businesses within it.

Per SF0104, the purpose of Wyoming’s chancery court is to “resolve disputes related to commercial, business, trust, and similar issues through the use of non-jury trials, alternative dispute resolution methods, and limited motions practice.”

In chancery court litigation, judges with a corporate law background preside over every case. Led by the principles of state law and precedent, these knowledgeable judges can settle business court matters efficiently, confidently, and with considerable ease compared to a traditional court.  

Situations that may be heard in Wyoming’s chancery court include:

  • Applications to stay or compel arbitration and affirm or disaffirm arbitration awards and related injunctive relief or appeals pursuant to W.S. 1‑21‑801 through 1‑21‑804 or 1‑36‑101 through 1‑36‑119, involving any of the foregoing enumerated issues
  • Breach of contract
  • Breach of fiduciary duty
  • Business transactions involving or arising out of dealings with commercial banks and other financial institutions
  • Commercial class actions
  • A dispute concerning the internal affairs of business organizations
  • A dispute concerning environmental insurance coverage
  • A dispute concerning commercial insurance coverage
  • Dissolution of corporations, partnerships, limited liability companies, limited liability partnerships, joint ventures, banks and trust companies
  • Fraud
  • Misrepresentation
  • Shareholder derivative actions
  • A statutory or common law violation involving the sale of assets or securities; a corporate restructuring; a partnership, shareholder, joint venture or other business agreement; trade secrets; or employment agreements not including claims that principally involve alleged discriminatory practices
  • Transactions governed by the Uniform Commercial Code
  • Transactions governed by the Wyoming Uniform Trust Code
