Melissa Burke is a Partner at Hathaway & Kunz, LLP, where she represents businesses, financial institutions, and employers in civil litigation and employment matters.

In her litigation practice, Melissa handles matters involving contract disputes, ownership and member disputes, fiduciary duty claims, and other complex business litigation in state and federal court. Her employment practice extends from the courtroom to the conference room — she litigates employment disputes and counsels employers on the full range of workplace issues, from employment agreements and wage-and-hour compliance to internal investigations and employee separations. She helps employers build defensible practices before disputes arise, and resolves them efficiently when they do.

Melissa approaches litigation with an eye toward early case assessment, strategic positioning, and efficient resolution. Her goal is to give clients a clear picture of their exposure and options at the outset — and to reach the best outcome without unnecessary cost or disruption, whether through negotiated settlement, dispositive motions, or full litigation.

Before joining Hathaway & Kunz, Melissa served as a law clerk to the Honorable Justice Kate M. Fox of the Wyoming Supreme Court. Having clerked on the Wyoming Supreme Court, she understands not just how cases are argued, but how they are decided — and she builds that perspective into her work from the first filing. She then practiced with a large regional law firm, focusing on civil litigation and energy and natural resources matters throughout the Rocky Mountain region.

Melissa earned her J.D., with honors, from the University of Wyoming College of Law and her B.A. in Political Science from the University of Wyoming. She is admitted to practice in Wyoming and Colorado.
